Child age 20 or below, depending on the category they fall under, will determine the visa type they get:  

✔️ F2A Visa, if the parent filing is still a green card holder. If the green card holder parent becomes the sponsor but naturalizes later, the category converts automatically, and your child gets an (IR2 Visa), which processes much faster. If the biological parent (green card holder) does not become a US citizen, then the F2A visa is a quota visa and can take as long as 5 years or longer to receive.

✔️ IR-2 Visa has a 5-Star ★★★★★ rating. If the US Citizen Stepparent becomes the sponsor, they may sponsor the child only if the marriage took place before the child’s 18th birthday. This would mean the US Citizen sponsor is the legal stepparent and can file for their stepchild to receive an IR-1 immediate relative visa, which moves much faster, taking between 12 and 15 months to get.

✔️ CR-2 or IR-2 Visa: This is specifically for a U.S. sponsor who has a foreign spouse and the foreign spouse’s children in another country. If the marriage is less than 2 years old at the time of filing with USCIS, the US sponsor can bring their foreign spouse and their children to the US with a CR-1 Visa for the spouse and a CR-2 Visa for the children, only if the marriage took place while the children were under the age of 18 years old.

For them to get IR-2 immediate relative Visas, both husband and wife must have already been married for two years or longer at the time of filing, and the children had to be under age 18 at the time of the marriage. If the child was age 18-20 at the time of the marriage, then the US sponsor cannot petition the child, and will need to wait until the child’s biological mother or father is already on US soil, at which point the biological parent can become their sponsor, and file for an F2A Visa.
