What Is a K1 Visa?
The K1 fiancé(e) visa allows a U.S. citizen to bring their foreign fiancé(e) to the United States for marriage.

How the Vietnam K1 Visa Process Works
The I-129F for Alien Fiance(e) process operates in three primary stages:
- Filing the Petition with USCIS
- Department of State Processing
- Entry and Marriage
Filing Form I-129F
- File with USCIS together with both the sponsors and the alien fiancées’ supporting documents.
- The correct filing fee is currently $675.
USCIS Approval
Allow USCIS processing time, which varies from applicant to applicant based on a number of things like:
- Previous marriages – divorce decrees, death certificates, annulments.
- Criminal records based on felonies, DUI-DWI, and domestic violence.

National Visa Center (NVC) Stage
This is where the USDHS requires vetting of the sponsor.

Ho Chi Minh City Interview Scheduling
After the National Visa Center has vetted the sponsor, it will forward the petition to the US Embassy or consulate to await a “Case Number” to be issued.

Visa Issuance and U.S. Entry
Once the alien fiancée has completed their US Embassy interview, they will be told whether they are approved, denied, or still under review.
- Approved, they will return to their home and wait 1 to 2 weeks for the Visa packet to be delivered.
- Denied, they will be given their Passport back with a letter explaining the reason for the denial.

Common Vietnam K1 Visa Red Flags
Certain situations may receive additional scrutiny during the Vietnam K1 process.
These can include:
Do age gaps cause denials?
USCIS and interviewers could view a couple’s age gap as a “red flag.”
Let’s say you have a Vietnamese woman, age 19, and a US sponsor, age 50. The 19-year-old woman is viewed as a young adult still learning how to make major decisions for herself in life. Whereas the 50-year-old adult US sponsor has much experience in life and grew up in a different era. Is it possible that this couple has anything in common?
In my opinion, the answer is “yes”. But through the eyes of immigration, who has been taught to spot fraudulent intent, they view this as a “red flag.” Cases like this still do get approved and can even get a K1 Visa. But much more work is needed to prove the relationship is genuine and sincere.
We specialize in assisting couples who fall under this type of situation. But before you file, it is highly recommended that you seek counseling to avoid rejection and, worse, a denial.
Here is another example: A Vietnamese woman, age 30, and the US sponsor, age 65. Do these types of applications also get “red-flagged” by USCIS and the US Embassy interviewer?
The answer is “No”.
The K1 applicant at age 30 is considered old enough to decide on this type, and therefore most of these cases are not “red-flagged.” However, all K1 Visa cases are being scrutinized, and we have seen perfect-aged couples get rejected or denied, and young women with older guys get approved.
Here are things to give the couple a fighting chance:
- The Couple has proof that they have been in a relationship for a year or even longer, which helps.
- The US sponsor has proof of visiting his fiancée on more than one trip.
- The couple has taken advantage of communicating and has kept everything in order.

▪️Plenty of chat logs to one another.
▪️Plenty of postal letters to one another.
▪️Saved financial support receipts.
▪️Documented gifts sent by making photos and saving receipts. - Vacations together were well documented:
▪️Plenty of photos of the couple together on trip one and trip two
▪️Important receipts have been saved, flight itinerary, boarding pass stubs, hotel receipts, etc.
▪️Receipts from all trips saved, such as restaurant, grocery, gift, transportation, events, etc.
▪️Providing proof of an engagement party is a huge expectation for interviewers.
▪️Providing notarized letters from your fiancé’s parents and family members is helpful. Each letter represents a character witness of the couple’s relationship. If you decide to do this, I highly recommend that you get counseling first, because each letter needs to be properly submitted for it to count.
Very short relationships
No matter what the age difference with this one is, if the relationship is only a couple of months old at the time of filing, your K1 application could get rejected. Now this isn’t always the case, but if the USCIS officers are going through your application and things look thin, in other words, lacking enough good quality photos of the couple, receipts, versus how long the vacation lasted, they may view your case as a hurry-hurry situation.
Even a short relationship can be approved if the officer sees plenty of supporting documents:
- A two- to three-week vacation together is much better than a one-week vacation.
- A minimum of 10 high-quality, unaltered photos of the couple together, preferably with the background visible, showing that you really are in Vietnam.
- Photos taken in different clothes and at completely different locations show that the couple wasn’t in a hurry. They spent quality time together in different locations, as seen in the pictures.
- Selfie photos are generally not a good selection to send to USCIS. Whole body or from the belly up are most acceptable. Nothing like smooching is needed. They just want to see a happy couple together.
- Purchasing gifts in Vietnam and saving receipts is very helpful.
- If possible, having some sort of engagement party, even a ring and proof, is extremely helpful.
- Be creative. We only mentioned a few ideas above. You can come up with many more believable ways to document your time together.
Few in-person visits
Regardless of the visa type, whether it is a K1 Fiancee visa or a marriage visa, the US sponsor should try to visit their loved one at least two times. Three is considered fabulous, two is fine, and one is weak. However, 3 trips of visiting for one week each isn’t always better than one good quality 3-week trip.
USCIS and the interviewer will be the ones who judge. If you told your story through documentation in a way that touches someone’s heart, then you have achieved a good report. A weak, poorly established timeline of events can get you a bad report. In other words, rejected.

Limited communication evidence
Today is the big day: Interview day, and you’re nervous, full of uncertainty about whether you will be approved or denied. Regardless of the age difference, if you attend your K1 interview with only a few pieces of paper in your hand and expect to get approved, then your only kidding yourself.
Interviewers are expecting you to come in with a solid case.
- Folders with communications documents all neat and organized.
- Emails, placed in order according to dates sent.
- Chat logs are all in order according to dates
- Phone call records from the sponsor showing real phone calls to the fiancée’s number in Vietnam.
- Postal letters, together with the envelopes they arrived in.
- Financial support records, again according to date.
- The fiancée needs to prove what she uses the money for to erase the doubt of misuse.
- Gifts sent should provide a credit card statement, delivery receipt, and photos holding the gift.
Language barriers
This is often looked at; if the sponsor speaks English and the fiancée speaks Vietnamese, the interviewer wants to know if both are communicating in English or Vietnamese. The alien fiancée may be tested in his or her English during the interview. If they struggle, it could be a red flag that would lead to more in-depth questioning.
Prior visa denials
This works both ways: If the US sponsor filed multiple times, then USCIS, with the help of IMBRA must determine if they are qualified or dubbed as a multiple filer.
For the alien fiancée, a more in-depth look at when, who, and why they were denied during prior attempts. If this happened, your case could be subject to an investigation leading either to an approval or denial.
Significant income differences
One of the most scrutinized steps during the interview is the sponsor’s income capabilities.
Tax records must be in order and checked for accuracy.
Checking account bank statements must also be in order and checked for accuracy.
In other words, the numbers better line up, and the legitimacy of your documents will be checked.
Online-only relationships
- A red flag does NOT automatically mean denial.
- Strong evidence and honest preparation can help couples overcome concerns.
How Long Does the Vietnam K1 Visa Process Take?
Can prior tourist visa denials hurt the case?
Usually, one prior tourist visa denial won’t hurt your case if it was made during the time of your relationship with your now US sponsor.
As long as the interviewer knows that you and your US sponsor tried to get a tourist visa to visit each other in the US and did so, dumbfoundedly, without fully understanding about getting a K1 Visa instead.
But for you, the alien fiancée, perhaps months or years earlier, you attempted to get a tourist visa, but it was denied. This looks like an attempt to get to the US under a pretense as a way to get married in the US so that you could stay.
US Embassy interviewers would much rather hear the truth coming from you rather than viewing you negatively. It is highly recommended that you seek counseling on this type of situation before filing, so that you know how to document this in your favor.
