K1 Visa I-134 – Who needs it, how and when does it get used. The I-134 affidavit of support is a financial breakdown of the petitioner (sponsors) financial capabilities. It is only needed during the Alien Fiance’s K1 Visa interview and is a requirement that helps interviewers determine if the sponsor can financially support the K1 Fiance, once they have arrived on U.S. soil.

At some point after receiving your I-797 Notice of Action Approval letter also known as the (NOA2) and waiting for your Case number to arrive the sponsor will provide a completed I-134 Application and all financial supporting documents to the alien fiance for use at the K1 Visa interview.

Not all sponsors have the same financial requirements based on many scenarios. Which category do you fall under?

Employed Sponsors
You may be an employee, and if so you’ll need to provide the following items.

  • I-134 completed and signed by the sponsor.

  • IRS Schedule 1040 Tax Return from the latest tax year.

  • W-2 Statement from the latest tax year.

  • 6 to 12 months of your checking account statements to cover the current year that has not been taxed yet.

  • Not required but helpful is a letter from your employer on the companies letter head if possible stating your employment date, your position, contact details of employer such as phone number, email etc.

As a sponsor do I earn enough?

If you are unsure, if your income meets the requirement, you can take a look here at the USCIS website I-864p and remember that you only need to meet the income requirement that falls under the 100%. This part is only during the interview.

Certain states are higher, like Alaska and Hawaii.

Once your alien fiance is in the United States and you both are married, the next process will be for your new husband or wife to adjust their status.

At that time you must file and I-864 Affidavit of support and now your income needs go up to the 125%. If you do not meet the 125% requirement then you can include any assets if you have any or you may find someone to be a joint sponsor.

What are some examples of assets:

  • If you out right own your home and can prove it.

  • If you out right own land and can prove it.

  • If you have a 401K that can be liquidated and can prove it.

  • If you have stock or bonds that can be liquidated and can prove it.

  • If you have a US Savings account untouched for at least one year and can prove it.

  • In some cases the alien fiance may use any substantial amount also as long as it is transferable and can prove it.

 

 

Self-employed Sponsors
You may be self-employed, and if so you’ll need to provide the following items.

  • I-134 completed and signed by the sponsor.

  • IRS Schedule 1040 Tax Return from the latest tax year.

  • W-2, 1090, or 1099 Statement from the latest tax year if applicable.

  • 6 to 12 months of your personal checking account statements to cover the current year that has not been taxed yet.


  • Business checking account regardless of how many, it would be your past 12 months.

  • If applicable provide a business license, state, city, or county.

 

Retired with a pension:
You may be a pensioner, and if so you’ll need to provide the following items.

  • I-134 completed and signed by the sponsor.

  • IRS Schedule 1040 Tax Return from the latest tax year.


  • Checking account Statements for the last 6 to 12 months.

 

Collecting Social Security Benefits:
You may be a collecting social security, or disability and even a pension if so you’ll need to provide the following items.

  • I-134 completed and signed by the sponsor.

  • IRS Schedule 1040 Tax Return from the latest tax year. for pensioners only.

  • If tax exempt you may be required to provide a certified letter of when exemption started.

  • Checking account Statements for the last 6 to 12 months.

 

Before applying for the K1 Visa:
It is important for all couples to learn and understand the sponsors financial capabilities and what will be required even before filing an I-129F for alien fiance.
