Who can use a K1 Fiance(e) Visa?

Regardless of the country in which your Fiance(e) resides, the K1 Visa is the only correct visa for immigrating to the USA to marry on.

The K1 is a single entry visa that is obtained after your Fiance(e) attends an interview at a US Consulate abroad where he or she resides. The K1 visa cannot be issued inside the US.

The chance of getting a K1 Fiance(e) Visa have a much higher success rate. In many cases a 100% guarantee can be given as long as the sponsor and beneficiary meet all of the requirements of USCIS, NVC & the US Embassy or Consulate of their Country in which the interview would take place.

The 90 day rule

Upon the K1 Fiance(e) finally arriving on US soil, They will need to spend time reuniting and maybe for some couples getting better acquainted? If this is you then be sure to make a decision to either marry before the (90) ninety days is up, or else it will be the responsibility of the sponsor to pay to send them back to their Country.

Failure to marry and failure to send them back to their country will result in removal processing or deportation proceeds and depending on the situation could lead to criminal punishment to both sponsor and beneficiary. If she marries someone other than you "the petitioner" and tries to stay, then she will eventually be deported. Also, you cannot extend the 90-day time for marriage. 

Once caught, the Fiancee's (or foreign wives if they married) have been deported from the U.S. and some have been, barred from entering the United States for 3, 5, even 10 years.

If for any reason you do not marry and she departs the U.S. within the 90 days, she will not be precluded from coming to the US in the future on another K1 visa and you will not be precluded from again bringing her or another foreign Fiance(e) to the US on a K1 visa.
